What is conditional release?
It is the release of a prisoner serving a prison sentence before that sentence ends, by decision of the competent authority. The release stays "conditional": if the released person breaches the conditions during the remaining period, the release can be revoked and he can be returned to serve the rest of the sentence.

Who can benefit from conditional release?
As a rule, conditional release is considered for a prisoner who meets conditions such as:
- A final judgment imposing a prison sentence.
- Having served the portion of the sentence set by the regulations.
- Good conduct and behaviour in prison, and the reports submitted about it.
- No danger to security or to the victim if he is released.
- In some cases, settling private rights (claims owed to a victim) or arranging their payment.
Some serious crimes are usually excluded or subject to stricter conditions. So the right question is not "does every prisoner qualify for conditional release?" but "what applies to this particular judgment?"
How is conditional release requested?
- Establish the position: the type of crime, the length of the sentence, how much has been served, and whether the judgment is final.
- Private rights: if the case involves a private right belonging to a victim, settling it or reaching a reconciliation makes a real difference. Read amicable settlement.
- The request: it is submitted through the prison administration and the competent authorities under the procedures in force, with supporting conduct reports and the programmes the prisoner has joined.
- Follow-up: once the decision is issued, the released person must keep to the set conditions for the whole remaining period.
