Property is the biggest thing most people own, and mistakes with it are expensive: an outdated deed, an incomplete sale contract, a tenant who does not pay, or an heir who blocks the sale of the family home. Usus Law Firm’s office in Al Olaya handles real estate cases in Riyadh: ownership, sale and transfer disputes, dividing property, leases and eviction, and checking and updating title deeds before you buy. We advise in English.

Real estate cases we handle

Leases and eviction A registered unified Ejar lease is an enforceable instrument filed with the Enforcement Court. Evicting a tenant
Dividing property between heirs or partners Division by agreement, or sale through the court if the property cannot be divided
Checking and updating deeds Checking the deed before buying, and updating it through the Real Estate Exchange. Updating a property deed

Eviction: two routes

Unified lease registered on Ejar Unregistered lease
Route Direct enforcement request on Najiz to the Enforcement Court A claim before the competent court first, then enforcement of the judgment
Speed Much faster Longer, because it goes through litigation

A landlord may ask for eviction if the tenant stays after the term ends, falls behind on rent under the contract and the law, or breaches the lease. A landlord may not remove a tenant by force or cut off utilities; doing so exposes the landlord to liability. See the Ejar unified lease contract.

Before you buy property

Warning signs before buying

  • The deed shows as not valid or suspended.
  • The owner’s name on the platform differs from the seller, or the seller acts under an old power of attorney.
  • The property is mortgaged to a financier.
  • The deed is in the name of a deceased person whose estate has not been divided.
  • The area or boundaries differ between the deed and reality.
  • Unexplained haste to transfer, or a large payment demanded before it.

Do not pay the full price except at the official transfer, or by a payment method that ties the transfer of ownership to the price. Foreign buyers should also read property ownership by non-Saudis.

The Real Estate Register

Property in the Kingdom is moving gradually to the Real Estate Register: each property gets a number and a record of its boundaries, area, owner and rights over it such as a mortgage. It is applied district by district; once your district is announced, registration is requested within the announced period. See the Saudi Real Estate Register.

Frequently asked questions

My tenant is not paying. Do I need a long lawsuit?

If the lease is a unified contract registered on Ejar, it is an enforceable instrument filed directly with the Enforcement Court, which is faster than an ordinary claim.

One heir refuses to sell the house. What can we do?

If the house cannot be divided in kind, the other heirs may ask the court to sell it and divide the price; one heir cannot block the rights of the rest.

Can you check a deed before I buy?

Yes, and it is always advisable: we check the deed’s status, details and any mortgage or restriction before you pay.

May a landlord cut electricity or water to force a tenant to pay or leave?

No. Rights are collected through lawful routes: enforcement or the court.

How much does a real estate lawyer cost?

It depends on the type, value and stage of the dispute; we state it in writing after the first consultation. See lawyer fees in Saudi Arabia.
