Before the official title transfer (known in Saudi Arabia as ifragh, الإفراغ), the seller and buyer usually sign a preliminary property sale contract that sets the price, the payments and the transfer date. This contract is what both sides rely on if the transfer is delayed, a mortgage comes to light, or one of them backs out. Below is a general property sale contract template you can copy, with an explanation of the clauses that protect both parties. A preliminary contract does not replace the official title transfer, which is what actually transfers ownership.

Does a preliminary contract transfer ownership of the property?
No. Ownership transfers through the official title transfer or registration in the Real Estate Register. The preliminary contract binds both parties to complete the sale and sets out the consequences of a breach.
The seller refused to transfer title after taking the deposit. What can I do?
You can ask the court to compel the transfer, or to cancel the sale with a refund of what you paid plus compensation, depending on the contract and the circumstances.
Do I need witnesses to the contract?
They are not a condition of its validity, but witnesses and clear signatures strengthen your evidence if there is a dispute.
