Misyar marriage is a valid Islamic marriage with all its pillars, in which the wife willingly gives up some of her rights, such as housing, overnight stays or maintenance. It is common and much asked about: is it valid? Is it registered? What are the wife's and children's rights? Can she take back what she gave up? Here are clear answers.
Quick answer
Misyar marriage is a valid Islamic marriage with all its pillars (offer and acceptance, a guardian, two witnesses and a dower) in which the wife willingly gives up some of her rights, such as housing, overnight stays or maintenance.
- The dower, the children's lineage, the children's maintenance and inheritance between the spouses all stand.
- Only housing, overnight stays and the wife's own maintenance may be waived by agreement.
- Usus Law Firm advises only on the legal side, such as registering the marriage; it does not provide matchmaking.
What is misyar marriage?
It is a marriage contract with all the pillars and conditions of marriage: offer and acceptance, a guardian, two witnesses, a dower, and no impediments between the spouses. The only difference is that the wife agrees to give up some rights she would normally have. Recognised fatwas have permitted it when its pillars and conditions are met.
What stands and what can be waived?
| Right | In misyar marriage |
|---|---|
| Dower | Stands; it must be stated, or the customary dower applies |
| Children's lineage | Established to the father with all its effects |
| Children's maintenance and rights | Fully owed and cannot be waived |
| Inheritance between spouses | Stands |
| Housing, overnight stays and the wife's maintenance | May be waived by agreement |
| Waiting period after separation | Required |

Must a misyar marriage be registered?
Yes. Registration protects the wife and children: it establishes lineage and inheritance and makes documents easier to obtain. Not registering exposes both sides to serious problems and may lead to liability. Read registering a marriage contract online. It is wise to write the agreed conditions clearly into the contract.
If a dispute arises
- The wife may claim what she did not waive, such as the deferred dower.
- The children may claim their full maintenance; the mother's waiver has no effect on it. Read custody and maintenance.
- The wife may seek separation by khul' or annulment when the grounds exist. Read khul' conditions.
- Disputes are heard by the Personal Status Court.
